Terms of Service
1. Scope, provider, and acceptance
These Terms of Service ("Terms") govern your use of the mawatu website (mawatu.app), the mawatu mobile app, and related services (together, the "Service").

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old. The Service is not directed at children. By using mawatu you confirm your age and that your information is accurate.
3. Account registration and security
You need an account for core features. Supported sign-in methods include email, Sign in with Apple, Google, and phone OTP.
You are responsible for safeguarding your credentials and all activity under your account. Notify us immediately at hello@mawatu.app if you suspect unauthorised access.
We may suspend or terminate accounts that violate these Terms, pose a safety risk, or are required by law.
4. Description of the Service
mawatu helps travelers discover people nearby, join or host activities, chat by city or activity, plan trips, and optionally share live location with trusted contacts. Features may change, be added, or discontinued. We strive for availability but do not guarantee uninterrupted access.
Some features require a paid mawatu Pro subscription (see section 10).
AI features provide generated suggestions only. They may be wrong, incomplete, or outdated. You are responsible for your own travel decisions.
5. Community rules
You agree to use the Service lawfully and respectfully. You must not:
- harass, threaten, stalk, discriminate against, or endanger others;
- post illegal, fraudulent, hateful, or sexually explicit content, especially involving minors;
- impersonate others or misrepresent your identity, age, or plans;
- share another person's live location, private messages, or personal data without permission;
- scrape, reverse engineer, or circumvent security, rate limits, or access controls;
- spam, solicit commercially, or advertise without our consent;
- use the Service to facilitate illegal activity;
- upload photos you do not have rights to, or that violate others' privacy.
We may remove content, restrict features, or ban accounts if we reasonably believe you breached these rules or endangered others. Serious violations may be reported to authorities.
6. User content and licence
You retain ownership of content you submit (profile text, photos, messages, activity details, etc.). By submitting content you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute that content solely to operate, secure, and improve the Service, including moderation and backups.
You confirm you have the necessary rights and that your content does not infringe third-party rights.
We may use automated and manual moderation. We are not obliged to monitor all content but may do so.
7. Photo verification
We may offer optional photo verification. Verification uses on-device comparison; verification selfies are not uploaded. A verified badge indicates we believe your photos match a live capture at verification time — not a background check, identity guarantee, or safety certification.
We may require re-verification if you change profile photos.
8. Location, Discover map, and Trusted Circle
Location features are optional.
- Discover map: other users see an approximate grid position, not your exact GPS fix. You can disable Discover sharing in settings.
- Trusted Circle: live location is shared only with contacts you explicitly accept. You can pause or revoke sharing anytime.
mawatu does not replace your judgment. Take reasonable precautions when meeting people. We do not conduct criminal background checks and do not guarantee any user's identity, intentions, or conduct.
To the extent permitted by law, we are not liable for users' actions online or offline. Report concerns in-app or to hello@mawatu.app.
9. Blocking, reporting, and enforcement
You can block users and report profiles, messages, or activities. We may investigate reports and take action including warnings, content removal, feature limits, or permanent bans.
Repeated or serious abuse may result in account termination without refund except where mandatory law requires otherwise.
10. Subscriptions and purchases (mawatu Pro)
Paid features are billed through the Apple App Store and/or Google Play via RevenueCat. Prices, billing periods, and trials are shown before purchase.
- Subscriptions renew automatically unless cancelled in your store account settings at least 24 hours before the period ends.
- Refunds are handled by Apple or Google under their policies; we cannot override store decisions.
- Statutory consumer rights in Germany and the EU remain unaffected.
EU consumers — digital content: If you purchase digital content not supplied on a tangible medium, you may have a 14-day right of withdrawal for distance contracts. By requesting immediate access and beginning use before the withdrawal period ends, you may lose the right of withdrawal once delivery has begun, to the extent permitted by § 356 (5) BGB and applicable law. Store-billed subscriptions are additionally governed by the platform provider's terms.
11. Intellectual property
The mawatu name, logo, app design, and our original content are protected by intellectual property laws. You may not copy, modify, or use our branding without written permission.
Third-party marks (Apple, App Store, Google Play, etc.) belong to their owners.
12. Third-party services
The Service integrates third-party providers (Supabase, Firebase, RevenueCat, OpenAI, Apple, Google, etc.). Their terms and privacy policies may also apply. Details on data processing are in our Privacy Policy.
13. Account deletion and termination
You may delete your account in the app. We explain that some chat messages may remain visible to others as "Deleted user" before you confirm.
We may suspend or terminate access for material breaches, legal requirements, or if continuing the Service becomes impracticable. Provisions that by nature should survive (liability limits, governing law, licences for already-distributed content) remain in effect.
14. Disclaimer
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant error-free, secure, or uninterrupted operation.
15. Limitation of liability
To the extent permitted by applicable law:
- We are liable without limitation for intent, gross negligence, and injury to life, body, or health.
- For simple negligence we are liable only for breach of essential contractual obligations (cardinal duties), limited to foreseeable, typical damage.
- Otherwise our liability is excluded.
Mandatory statutory liability (including under the German Product Liability Act) remains unaffected.
16. Changes to these Terms
We may update these Terms when the Service, legal requirements, or our business changes. The current version is published at mawatu.app/terms. For material changes we will notify you in the app or by email where appropriate. Continued use after the effective date constitutes acceptance, unless applicable law requires your explicit consent.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer with habitual residence in the EU, you retain mandatory protections of your country of residence.
For merchants, the exclusive place of jurisdiction is Berlin, Germany, where permitted. For consumers, jurisdiction follows statutory rules.
