Terms of Service
1. Scope and provider
These Terms of Service ("Terms") govern your use of the MaWaTu website (mawatu.app), the MaWaTu mobile app, and related services (together, the "Service").

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use MaWaTu. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.
The Service is not intended for children. We do not knowingly allow users under 18.
3. Account registration and security
To use core features you need an account (e.g. via email or Sign in with Apple). You are responsible for keeping your login credentials confidential and for all activity under your account.
Notify us immediately at hello@mawatu.app if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a safety risk.
4. The Service
MaWaTu helps travelers discover people nearby, join or host activities, chat, and share location with trusted contacts. Features may change, be added, or be discontinued. We strive to keep the Service available but do not guarantee uninterrupted access.
Some features require a paid subscription ("MaWaTu Pro" or similar). Subscription terms are set out in section 9.
5. Your conduct and community rules
You agree to use MaWaTu lawfully, respectfully, and in line with our community purpose. In particular, you must not:
- harass, threaten, stalk, or discriminate against others;
- post illegal, fraudulent, misleading, or sexually explicit content involving minors;
- impersonate another person or misrepresent your identity, age, or travel plans;
- scrape, reverse engineer, or attempt to bypass security or rate limits;
- use the Service for spam, unsolicited advertising, or commercial solicitation without our consent;
- share another person's live location or private data without permission;
- arrange or facilitate illegal activities.
We may remove content, restrict features, or terminate accounts if we reasonably believe you have breached these rules or endangered other users.
6. User content and licence
You retain ownership of content you submit (profile text, photos, messages, activity details, etc.). By submitting content you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute that content solely to operate and improve the Service.
You confirm that you have the rights to the content you upload and that it does not infringe third-party rights.
We may use automated and manual moderation to enforce these Terms. We are not obliged to monitor all user content but may do so.
7. Location, safety, and Trusted Circle
Location features are optional. Approximate location may be used to show nearby travelers. Live location sharing is only enabled with your explicit consent and only with contacts you accept in Trusted Circle. You can revoke sharing at any time in the app.
MaWaTu is a tool to help people connect — it does not replace your own judgment. Always take reasonable precautions when meeting people in person. We do not conduct background checks on users and do not guarantee the identity, intentions, or conduct of any user.
To the fullest extent permitted by law, we are not liable for the actions of users online or offline. Report concerns via the in-app reporting tools or hello@mawatu.app.
8. Intellectual property
The MaWaTu name, logo, app design, and our original content are protected by copyright, trademark, and other laws. You may not copy, modify, or use our branding without written permission.
"Apple", "App Store", "Google Play", and related marks are trademarks of their respective owners.
9. Subscriptions and purchases
Paid features are billed through the Apple App Store and/or Google Play (and may be managed via RevenueCat). Prices, billing periods, and trial offers are shown in the app before purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Manage or cancel subscriptions in your device's store account settings.
- Refunds are handled by Apple or Google according to their policies; we cannot override store refund decisions.
- If a free trial is offered, unused portions are forfeited when you purchase a subscription, where applicable under store rules.
Statutory rights for consumers in Germany and the EU (including withdrawal rights where applicable) remain unaffected.
10. Third-party services
The Service integrates third-party providers (e.g. Supabase, Firebase, OpenAI, payment platforms). Your use of those services may be subject to their terms. Details on data processing are in our Privacy Policy.
11. Termination
You may delete your account at any time in the app. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if continuing the Service becomes impracticable.
Upon termination, your right to use the Service ends. Provisions that by nature should survive (e.g. liability limits, governing law) remain in effect.
12. Disclaimer
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or meet your expectations.
13. Limitation of liability
To the extent permitted by applicable law, [Company Name GmbH] and its directors, employees, and affiliates are liable without limitation for intent and gross negligence and for injury to life, body, or health.
For simple negligence we are liable only for breach of essential contractual obligations (cardinal duties), and then limited to foreseeable, typical damage. Otherwise our liability is excluded.
The above does not limit mandatory statutory liability (including under the German Product Liability Act).
14. Changes to these Terms
We may update these Terms when the Service, legal requirements, or our business changes. We will publish the current version on mawatu.app/terms and, for material changes, notify you in the app or by email where appropriate. Continued use after the effective date constitutes acceptance, unless applicable law requires your explicit consent.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer with habitual residence in the EU, you also benefit from mandatory protections of your country of residence.
For merchants, the exclusive place of jurisdiction is Berlin, Germany, where permitted by law. For consumers, jurisdiction follows statutory rules.
